CareCubed is operated by iESE Innovation Ltd (“we”, “us” or “our”). We are registered in England and Wales under company number 08490888, with our registered office address being iESE Innovation Ltd, Maritime Place, Quayside, Chatham Maritime, Chatham, Kent ME4 4QZ. By using CareCubed you accept these terms

By using CareCubed, you confirm that you accept these terms of service and that you agree to comply with them. If you do not agree to these terms, you must not use CareCubed. We recommend that you print a copy of these terms for future reference.

We amend these terms from time to time.

We may suspend or withdraw CareCubed

We do not guarantee that CareCubed, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of CareCubed for business and operational reasons in accordance with the terms of our licence agreement with your organisation (the “Licence Agreement”). We will try to make CareCubed available to you in accordance with the terms of the Licence Agreement, and give you or your organisation reasonable notice of any suspension or withdrawal in accordance with the terms of that Licence Agreement.

CareCubed is only for users in the UK

CareCubed, its content and any services provided in relation to the same are only targeted to, and intended for use by, individuals located in the United Kingdom. We do not represent that content available on or through CareCubed is appropriate for use or available in other locations.

By continuing to access, view or make use of CareCubed and any related content and services, you hereby warrant and represent to us that you are located in the United Kingdom. If you are not located in the United Kingdom, you must immediately discontinue use of CareCubed and any related content and services.

You must keep your account details safe

When registering to use CareCubed, you must provide details of your organisation and your personal account information that are accurate to the best of your knowledge. If your own or your organisation’s details change you must immediately update us either via your account screens or by contacting iESE directly.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party and you will be responsible for all activities that occur or cases that are shared or submitted under your username and password combination.

We have the right to disable any user account, or any user identification code or password (whether chosen by you or allocated by us) at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of service.

If you know or suspect that anyone other than you knows your user identification code or password, you must notify us immediately at carecubed@iese.org.uk.

How you may use material on CareCubed

We are the owner (or the licensee) of all intellectual property rights in CareCubed, and in the materials published on it. You acknowledge that all intellectual property rights in CareCubed and the related documentation throughout the world belong to iESE (or its licensors) and that you have no rights in, or to, CareCubed or the related documentation other than the right to use them in accordance with these terms of service. We may collect and analyse data and other information entered by you into CareCubed or derived from your use of CareCubed and use it for our legitimate business purposes, provided that such data is aggregated and anonymised.

You may use CareCubed only for the internal business purposes of your organisation. You may display the content of CareCubed on a computer or internet connected device, store downloaded cases in electronic form on disk or print copies for internal use, provided you keep intact all and any trademarks and proprietary notices and acknowledge iESE as the authors of content on CareCubed (except where the content is user-generated). You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content that you have printed off or downloaded in any way from CareCubed without written permission from iESE.

If you print off, copy, download, share or repost any part of CareCubed in breach of these terms of service, your right to use CareCubed will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

No text or data mining, or web scraping

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to CareCubed or any services provided via, or in relation to, CareCubed for any purpose, including the development, training, fine-tuning or validation of AI systems or models, and we do not consent to any such activities. This includes using (or permitting, authorising or attempting the use of):

  • any “robot”, “bot”, “spider”, “scraper” or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of CareCubed or any data, content, information or services accessed via the same; and
  • any automated analytical technique aimed at analysing text and data in digital form to generate information or develop, train, fine-tune or validate AI systems or models which includes but is not limited to patterns, trends and correlations.

The provisions in this clause should be treated as an express reservation of our rights in this regard. This clause will not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.

Uploading content to CareCubed

Whenever you make use of a feature that allows you to create content directly on CareCubed, upload or share content to CareCubed, or to make contact with other users of CareCubed, you must comply with the standards set out in our Acceptable Use Policy.

You warrant that any such contribution complies with those standards, and you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

We have the right to remove any content you upload to CareCubed if, in our opinion, it does not comply with the acceptable use standards set out in our Acceptable Use Policy.

If you wish to contact us in relation to content you have uploaded to CareCubed and that we have taken down, please contact carecubed@iese.org.uk.

User-generated content is not approved by us

CareCubed may include information and materials uploaded by other users. This information and these materials have not been verified or approved by us and we accept no responsibility for that information or materials.

Do not rely on information on CareCubed and fitness for purpose

The content on CareCubed is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on CareCubed.

Although we make reasonable efforts to update the information on CareCubed, we make no representations, warranties or guarantees, whether express or implied, that the content on CareCubed is accurate, complete or up to date.

You acknowledge that CareCubed is provided “as is” and has not been developed to meet your individual requirements, and that it is therefore your responsibility to ensure that the facilities and functions of CareCubed as described in the related documentation meet your requirements.

We are not responsible for websites we link to

Where CareCubed contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over, and are not responsible for, the contents of those sites or resources.

We are not responsible for viruses

We do not guarantee that CareCubed will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platform to access CareCubed. You should use your own virus protection software.

You must not introduce viruses

You must not misuse CareCubed by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or otherwise harmfully interacting with CareCubed or any part of it. You must not attempt to gain unauthorised access to CareCubed, the server on which CareCubed is stored or any server, computer or database connected to CareCubed or any other equipment or network connected with CareCubed. You must not interfere with, damage or disrupt any software used in the provision of CareCubed or any equipment or network or software owned or used by any third party on which this site relies in any way. You must not attack CareCubed via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use CareCubed will cease immediately.

How we may use your personal information

We will only use your personal information as set out in our https://carecubed.org/privacy-policy.

Liability

To the maximum extent permitted by applicable law, we exclude all liability (whether arising in contract, tort, breach of statutory duty or otherwise) which we may otherwise have to you as a result of:

  • any error or inaccuracies in any information or material within or relating to CareCubed; and
  • the unavailability of CareCubed for any reason whatsoever.

Under no circumstances shall we be liable to you for any loss or damage suffered (including without limitation direct or indirect losses) arising from your use of, or reliance on, CareCubed.

However, we do not exclude or limit our liability for death or personal injury arising from our negligence, for any fraudulent misrepresentation made by us on CareCubed or for any other statutory rights which are not capable of being excluded.

If you are in breach of any of these terms of service, we may cease your right to use CareCubed immediately and you agree to indemnify and hold us harmless in respect of any costs, expenses, claims, proceedings, actions, losses, damages or liabilities incurred by us in relation to or arising from such a breach.

Governing law

These terms are governed and construed in accordance with the laws of England and you consent to the exclusive jurisdiction of the courts of England.
